JUSTICE HANCHATE SANJEEVKUMAR ORAL JUDGMENT The appellants and respondent are present before the Court along with their respective Advocates and have field memorandum of joint compromise petition under Order XXIII Rule 3 of Code of Civil Procedure (CPC). 2. Learned counsel appearing on behalf of both the parties submitted that the matter is settled between the parties and the appellants have agreed to reimburse an amount of Rs.11,00,000/- to the respondent/plaintiff. - 3 - HC-KAR NC: 2026:KHC:33497 RFA No. 2118 of 2023 The respondent/plaintiff has already received an amount of Rs.9,00,000/- from the appellants/defendants. 3. Further, on 02.07.2026, the appellants/defendants have paid an amount of Rs.2,00,000/- in the form of demand draft bearing DD No.852778, dated 02.07.2026 drawn on Bank of Baroda, Vidyanagar, Mandya Branch, which is annexed as Annexure-A and these conditions are reflected in the compromise petition. Therefore, pray to dispose of the appeal in terms of the compromise petition. 4. Joint compromise petition is placed on record. 5. Consequently, the appeal is disposed of in terms of the compromise petition. 6. Draw decree accordingly. 7. Registry is directed to refund the Court fee paid by the appellants as per law with proper identification of the appellants. 9. Learned counsel appearing on behalf of the respondent/plaintiff submitted that the respondent/plaintiff has deposited a sum of Rs.1,00,000/- before the Trial Court. Hence, the respondent/plaintiff is permitted to withdraw the said amount deposited before the Trial Court and the Trial Court shall release the said amount of Rs.1,00,000/- in favour of the respondent/plaintiff upon proper identification.
