This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants arrested in connection with Crime No. 312/2026 registered at Police Station – Pulgaon, Out Post – Jewra Sirsa, District – Durg (C.G.) for the offence punishable under Section 191(3), 191(2), 296, 109 and 3(5) of the BNS. 2. Case of the prosecution, in brief, is that on 31.03.2026 the complainant Abhishek Jaiswal lodged a report at Police Station Jewra Sirsa, Durg stating that he was standing near a daily needs shop along with his friends Kishan Dhimar at that time, present applicant, other co-accused Vishal Ladwal, Rahul Mahanand, Abhishek Sao, Hareram Chauhan, Ritik Uike and Pramod Chauhan RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 and their associates arrived in a motor cycle and Activa, and allegedly started abusing him with filthy language without any provocation. When the complainant objected, they allegedly threatened to kill him and assaulted him with fists, kicks, and some of the accused assaulted them with a sharp knife causing serious injuries on his back, chest, and abdomen, and Sagar Sahu sustained a knife injury on his left thigh. On the basis of the said report, Crime was registered at P.S. pulgaon out post Jewra Sirsa Durg against all accused persons. Hence, this application. 3. Learned counsel appearing for the applicants submits that the applicants are innocent and has been falsely implicated in the present case and the chargesheet has been filed in this case. It is submitted that the applicants are in jail since 02.04.2026, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the applicant along with the co-accused is said to have assaulted the injured with thermacol cutter, due to which he sustained one incise wound on neck and two lacerated wound and on the injury No.1 is found to be grievous in nature. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case 3 and also considering the fact that the applicant along with the co- accused is said to have assaulted the injured with thermacol cutter, due to which he sustained one incise wound on neck and two lacerated wound and on the injury No.1 is found to be grievous in nature, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, this bail application of applicant – Abhishek Pratap Gond, involved in Crime No. 312/2026 registered at Police Station – Pulgaon, Out Post – Jewra Sirsa, District – Durg (C.G.) for the offence punishable under Section 191(3), 191(2), 296, 109 and 3(5) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
