JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.222/2025 registered by Chikkamagaluru Town Police Station for the offences punishable under Sections 352, 115(2), 126(2), 118(2), 109(1), read with Section 3(5) of BNS, 2023 is before this Court in this successive bail application filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.222/2025 was registered by Chikkamagaluru Town Police Station for the aforesaid offences against the petitioner and others based on the first information dated 28.12.2025 received from Anilkumar, who is the injured victim in the present case. In the said case, petitioner was arrested on 29.12.2025 and remanded to judicial custody. After completing - 3 - HC-KAR NC: 2026:KHC:35034 CRL.P No. 7577 of 2026 investigation, charge sheet is now filed against four persons and petitioner is arraigned as accused No.1 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.220/2026 was rejected on 21.04.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that the petitioner is a youngster aged about 20 years and all the other accused persons have been released after charge sheet is filed. The injured victim and the petitioner are friends and incident has taken place inside a bar and restaurant after parties had consumed alcohol. Accordingly, he prays to allow the petition. 5. Per-contra, learned High Court Government Pleader who has opposed the petition submits that, petitioner is a person with criminal antecedent and in the event he is enlarged on bail, he is likely to indulge in committing similar offence. The allegation as against the petitioner is that, on the alleged date of incident, at about 19.30 hours, inside the bar and restaurant where accused persons and the injured victim were consuming alcohol, the petitioner allegedly had quarreled with the victim for the reason that he was starring at him. In the said incident, petitioner allegedly had assaulted the victim with a knife causing blood oozing wounds. The victim who was admitted in the hospital was discharged from the hospital after 4 days from the alleged date of incident and his condition is said to be stable. It is not in dispute that all other accused persons except the petitioner have been granted regular bail in the present case. 7. Investigation of the case is completed and charge sheet has been filed. After the earlier bail application of the petitioner was rejected by this Court, the other accused persons have also been granted regular bail by the jurisdictional Sessions Court. The petitioner is in custody in the present case for the last 6 months. Under - 5 - HC-KAR NC: 2026:KHC:35034 CRL.P No. 7577 of 2026 the circumstances, I am of the view that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.222/2025 registered by Chikkamagaluru Town Police Station for the offences punishable under Sections 352, 115(2), 126(2), 118(2), 109(1), read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR NC: 2026:KHC:35034 CRL.P No. 7577 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of. f) Petitioner shall appear before the Station House Officer of Chikkamagalur Town Police Station between 10.30 a.m. and 01.00 p.m. on every second and fourth Sunday of the month and mark his attendance, till the case registered against him is disposed of. g) In the event, petitioner violates any of the bail conditions, the State is at liberty to file necessary application seeking cancellation of his bail.
