Opposite parties are not represented. In this application, the petitioners have prayed for a direction upon the court below for expeditious disposal of G.R. case no. 318 of 2023, presently pending before the learned Judicial Magistrate, 2nd Court, Barrackpore. Learned counsel for the petitioners submit that in this case, FIR was registered against the petitioners on 10th January, 2023 and after completion of investigation, police submitted charge-sheet on 23rd March, 2023 and the court below had taken cognizance upon the offences on 16th May, 2024. Since then, the matter is pending for charge hearing. Therefore, the petitioner’s counsel submits that such long pendency of the instant criminal proceeding violates his fundamental right to speedy trial and as such, the court below may be directed for expeditious disposal of the aforesaid criminal proceeding after preponing the next date. Having heard learned counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous. 2 In fact, after framing of charge in the month of March, 2023, the case is keept pending for charge hearing for the last three years and as such, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. The next date is fixed by the court below on 4th June, 2027. In view of above, the instant application being CRR 4759 of 2025 is hereby disposed of with a direction upon the court below to prepone the date and to fix a date for charge hearing in the month of September, 2026 and to conclude the charge hearing on the pre-poned date or preferably within a month thereafter.
