INDIRESH ORAL ORDER In this petition, the petitioner is challenging the order dated 22nd July, 2021 (Annexure-K) passed by the respondent No.4; inter alia sought for a direction to the respondents 3 and 4 to enter the name of the petitioner in the RTC as per M.R. No.4/1991-92 (Annexure-C). 2. Heard Sri. Krishnamoorthy D., learned counsel appearing for the petitioner and Smt. H.V. Sharada, learned Additional Government Advocate appearing for respondents. 3. Sri. Krishnamoorthy D., learned counsel appearing for the petitioner, by referring to the reasons assigned by the respondent No.4 in the impugned order dated 22nd July, 2021 (Annexure-K), submits that the land in question is the ancestral property of the petitioner and in this regard mutation has been made as per M.R. No.58/1971-72 (Annexure-B). Learned - 3 - HC-KAR NC: 2026:KHC:35000 WP NO.23748 OF 2021 counsel appearing for the petitioner also refers to the observation made by this Court in the order dated 12th February, 2016 (Annexure-H) passed in Writ Petition No.58477 of 2015 and sought for interference of this Court. 4. Per contra, Smt. H.V. Sharada, learned Additional Government Advocate appearing for respondents sought to justify the impugned order dated 22nd July, 2021 (Annexure-K) and submitted that the petitioner has to establish her right over the property in question. Accordingly, she sought for dismissal of the petition. 5. In the light of submission made by learned counsel appearing for the parties, I have carefully perused the mutation in M.R. No.58/171-72 (Annexure-B), wherein, it is mentioned that the husband of the petitioner viz., Govindaiah got property in question in terms of the family Parikath. On perusal of the observation made by this Court in Writ Petition No.58477 of 2017 disposed of on 12th February, 2016 (Annexure-H) and also by looking into the RTC Extracts produced by the petitioner, I am of the view that the reasons assigned by the respondent No.4 in the impugned order dated 22nd July, 2021 - 4 - HC-KAR NC: 2026:KHC:35000 WP NO.23748 OF 2021 (Annexure-K) in respect of Sarkari Beelu is incorrect. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 22nd July, 2021 (Annexure-K) passed by the respondent No.4 is hereby set- aside and matter is remitted back to the respondent No.4 to take decision in matter afresh in the light of observation made by this Court at paragraph 3 in Writ Petition No.58477 of 2015 disposed of on 12th February, 2016 (Annexure-H), within a period of three months from the date of receipt of this order.
