The Applicant – Piyush Kumar alias Kapil – is before this Court seeking anticipatory bail in connection with Case Crime No. 0349 of 2025, registered at Police Station Vikas Nagar, District Dehradun, for the offences punishable under Sections 108 and 351(3) of the Bharatiya Nyaya Sanhita, 2023. 4. Heard learned counsel for the Applicant and learned State Counsel. Perused the record. 5. Learned counsel for the Applicant submits that there is an inordinate delay in lodging the FIR; that the Applicant has no concern whatsoever with the alleged act of mental harassment towards the deceased, namely Vijendra Singh. It is further submitted that the co- accused persons, namely Rajneesh Kumar Saini and Diljot Singh, preferred Anticipatory Bail Application and Writ Petition (Criminal), respectively, in connection with the present crime, and vide orders dated 16.01.2026, protection has been granted to the said co-accused persons. 6. Learned State Counsel opposes the Anticipatory Bail Application and submits that the investigation is still in progress. 7. Personal liberty under Article 21 of the Constitution of India is a valuable fundamental right and can be curtailed only in accordance with law and in compelling circumstances. 8. Considering the facts and circumstances of the case, the nature of allegations, the parity with the co-accused who have already been granted protection, and without expressing any opinion on the merits of the case, this Court is inclined to grant anticipatory bail to the Applicant. 9. Accordingly, in the event of arrest, the Applicant – Piyush Kumar alias Kapil – shall be released on anticipatory bail upon furnishing a personal bond of ₹30,000/- and two reliable sureties, each in the like amount, to the satisfaction of the Arresting Officer/concerned Court, subject to the following conditions: (i) The Applicant shall cooperate with the investigation and shall appear before the Investigating Officer or the Trial Court as and when required; (ii) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) The Applicant shall not leave the country without prior permission of the Trial Court. 10. It is clarified that if the Applicant misuses the liberty granted or violates any of the conditions imposed, the prosecution shall be at liberty to move an appropriate application for cancellation of anticipatory bail. 11.
