9.7.2026 31 sb CRR 695 of 2026 Savita Liladhar Vaswani Vs. Ketan Dungarsi Nagrecha & Ors. Mr. Avijit Ghoshal …for the Petitioner Affidavit of service filed by the petitioner is taken on record. Opposite parties are not represented. In this application, the petitioner is aggrieved with the inordinate delay caused in proceeding further in connection with the complaint case being no. C/228 of 2024, presently pending before the learned Judicial Magistrate, 5th Court, Sealdah. Learned counsel for the petitioner submits that the petitioner filed a complaint case under Sections 406/418/420/421 read with Section 120B of the IPC. By an order dated 29.6.2024, the Trial Court took cognizance against the offence and the case record was transferred to the learned Judicial Magistrate, 5th Court, Sealdah. He further submits that since then, the matter is pending for moving towards next step i.e. recording of initial deposition of the complainant’s witness. It is further submitted that the next date is fixed on 16th July, 2026 and therefore, the petitioner has prayed for necessary direction upon the court below for expeditious hearing of the aforesaid criminal proceeding. 2 Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and I find from the submission of the petitioner that the matter is pending for recording initial deposition for more than two years and therefore, the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 695 of 2026 is hereby disposed of with a direction upon the court below to expedite further hearing of the said complaint case and to conclude the same at the earliest. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
