This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.134/2025, registered at Police Station – Saja, District Bemetara, C.G., for commission of offence punishable under Section 103(1) of BNS. 2. Case of the prosecution, in brief, is that on 02.06.2025, on the basis of merg intimation lodged by the complainant Pawan Banjare, it was AKHILESH BEOHAR Digitally signed by AKHILESH BEOHAR Date: 2026.07.20 17:04:43 +0530
2 alleged that the applicant demanded a share in 1.5 acres of land from the deceased- Gulab Joshi. Upon refusal by the deceased, the applicant allegedly assaulted him with a stick, causing injuries, as a result of which, he succumbed to the same. On the basis of the aforesaid allegations, the present crime has been registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that no offence has been committed by the applicant. He also submits that some of the prosecution witnesses have been examined, but none of them have supported the case of the prosecution. The applicant is in custody since 03.06.2025, and the conclusion of the trial is likely to take considerable time. Therefore, it is prayed that the applicant be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that it is the applicant who has committed the murder of his father-deceased on account of a dispute regarding partition of land. It is further submitted that the applicant assaulted the deceased with a bamboo stick, as a result of which, the deceased sustained grievous injuries and died on the spot and that the dead body of the deceased was found in the house where the applicant was residing.
Therefore, it is contended that the applicant is not entitled to be released on bail. 5. Heard learned counsel for the parties. 3
6. Considering the facts and circumstances of the case, the nature and gravity of the offence and the material available on record, this Court is not inclined to grant bail to the applicant. 7. Accordingly, the bail application stands dismissed. Sd/- (Radhakishan Agrawal) Judge Akhilesh
