JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 4 are before this Court calling in question proceedings in C.C.No.28726/2021, pending before the VI Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 498A, 323 and 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the concerned family Court in M.C.No.6358/2025 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center. They have filed a compromise petition / application under Sections 359 r/w. 528 of the BNSS along with a joint affidavit before this Court seeking permission to compound the offences. 3. The compromise petition / application reads as follows: - 5 - HC-KAR NC: 2026:KHC:31648 CRL.P No. 8371 of 2026 1. “The Respondent No.2 had lodged a complaint dated 04.09.2020 before the Respondent No.1 Police, which came to be registered as Crime No.125/2020 by East Zone Women Police Station, Bengaluru, and after investigation, charge sheet has been filed against the Petitioners in C.C. No.28726/2021 pending on the file of the learned XXXIX Additional Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 498A, 323, 506 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. The Petitioners and Respondent No.2 submit that the dispute between the parties arose out of matrimonial differences between Petitioner No.1 and Respondent No.2. The other Petitioners are the family members/relatives of Petitioner No.1, and they have been arrayed as accused in connection with the matrimonial dispute. 3. It is submitted that during the pendency of the above Criminal Petition, at the intervention of elders, well- wishers, family members and responsible persons, the parties have amicably settled all their disputes. Respondent No.2 does not intend to proceed further with the criminal case against the Petitioners. 4. It is submitted that the compromise arrived at between the Petitioners and Respondent No.2 is voluntary, lawful and genuine. The same has been entered into without any force, threat, coercion, undue influence or pressure from any person whomsoever. 5. It is submitted that the disputes between Petitioner No.1 and Respondent No.2 being personal and matrimonial in nature have been resolved amicably. In view of the settlement, continuation of the proceedings in C.C. No.28726/2021 would serve no useful purpose and would only amount to abuse of the process of law. 6. Respondent No.2 submits that she has no objection for this Hon'ble Court to record the compromise and to quash the entire proceedings in C.C. No.28726/2021 pending on the file of the learned XXXIX Additional Chief Metropolitan Magistrate, Bengaluru, arising out of Crime No.125/2020 of East Zone Women Police Station, Bengaluru, insofar as the Petitioners are concerned. - 6 - HC-KAR NC: 2026:KHC:31648 CRL.P No. 8371 of 2026 7. It is submitted that though some of the offences alleged are non-compoundable in nature, the dispute is essentially private, personal and matrimonial in nature, and the parties having amicably resolved the matter, this Hon'ble Court may be pleased to exercise its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to secure the ends of justice. 8. Hence, this application is filed seeking the kind permission of this Hon'ble Court to record the compromise entered into between the Petitioners and Respondent No.2 and consequently allow the Criminal Petition by quashing the proceedings in the interest of justice and equity. Wherefore, this Hon'ble Court be pleased to accord permission to compound the offences in C.C. No.28726/2021 pending on the file of the learned XXXIX Additional Chief Metropolitan Magistrate, Bengaluru (Crime No.125/2020 of East Zone Women Police Station) for the offences punishable under Sections 498A, 323, 506 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, and consequently be pleased to allow the main petition filed under Section 482 of CrPC as prayed for therein in the interest of justice and equity.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms as afore-quoted and terminate the proceedings against the petitioners, as the allegations are not against the State. - 7 - HC-KAR NC: 2026:KHC:31648 CRL.P No. 8371 of 2026 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.28726/2021, pending before the VI Additional Chief Metropolitan Magistrate, Bengaluru, qua the petitioners, stand quashed.
