Also heard Mr. J K Goswami, learned counsel for the respondent Nos. 1, 2, 3 & 5 as well as Ms. R B Boro, learned counsel for the respondent No. 4. 2. The appellant is a registered Gaushala (cow shelter home) engaged in the preservation, protection and welfare of cows, duly recognized by the Animal Welfare Board of India. The appellant’s case is that in view of the work done by the appellant, the State is to pay to the appellant an amount of Rs. 16,16,29,460/- towards expenses for maintaining the cows. Further, in terms of Rule 12 (4) of the Assam Cattle Preservation Rules, 2022, the State Government is to reimburse such maintenance expenses incurred by the appellant. 3. The appellant’s counsel submits that though WP(C) No. 329/2026 had been filed before the learned Single Judge praying for reimbursement of the expenses incurred by the appellant, for maintaining the cows and an interim prayer had been made to release at least 50% of the amount of Rs. 16,16,29,460/-, the learned Single Judge has not taken any decision on the interim prayer made by the appellant. He accordingly submits that the learned Single Judge should take a decision on the interim prayer made by the Page No.# 3/3 appellant. 4. Learned counsels for the respondents submit that the matter can be remanded back to the learned Single Judge to take a decision on the interim prayer of the appellant. 5. On considering the submissions made by the learned counsels for the parties and as an interim prayer has been made in the writ petition, the matter is remanded back to the learned Single Judge to take a decision on the interim prayer made by the appellant. 6.
