Learned senior advocate appearing for the petitioners submits that prayer for bail of the present petitioners are being renewed as both of them are in custody for more than three years and till date, only 4 witnesses have been examined out of 19 witnesses cited by the prosecution. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the injured. I have taken into account the genesis of the dispute, the intention to assault the victim and the fact that after about six days of the incident, the victim succumbed to the injuries. 2 Having considered the manner in which the incident complained of took place and there was dispute existing between the present petitioners as well as the deceased and his associates as also the fact that the prosecution could not apprise this Court that there are criminal antecedents of the present petitioners, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Ajim Sk., and 2. Arif Sk. shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Jangipur, Murshidabad. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Trial Court. Additionally, the petitioners shall not enter the jurisdiction of Raghunathganj Police Station and petitioners would furnish their address where they would reside before release to the learned Additional Chief Judicial Magistrate, Jangipur. The petitioners shall also meet with the Officer-in- Charge/Inspector-in-Charge of the local police station where they would reside once in a fortnight till the same is modified by the learned Trial Court. 3 Mr. Rajendra Banerjee, learned APP along with Mr. Suman Chakraborty, learned advocate was directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities. The application for bail, being CRM (M) 2879 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
