Affidavit of service filed by the petitioner is taken on record. Opposite parties are not represented. In this application, the petitioner is aggrieved by and dissatisfied with the delay in disposal of G.R. case no. 1082 of 2010 arising out of Ashoke Nagar Police Station case no. 98 of 2010 under Section 498A/406/34 of the IPC. Learned counsel for the petitioner submits that in the year 2010, an FIR was lodged and on 8.5.2010, the charge-sheet was submitted by the Investigating agency. The charge was framed in the year 2013 but since then, not a single witness could be examined by the court below. The petitioner being the complainant further submits that she is attending court everyday to adduce evidence but due to non-cooperation on the part of the counsel of both the parties, her evidence could not be recorded as yet. Therefore, the Trial court may be directed to make expeditious disposal of the aforesaid criminal proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is
2 innocuous. Furthermore, the criminal proceeding is pending for about more than 16 years and as such, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 5203 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid proceeding and to conclude the trial preferably within a period of six months from the next date of hearing.
