HARI HARANADHA SARMA CRIMINAL PETITION NO: 4167/2026 ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.492 of 2025 of Vijayawada II Town Police Station, NTR District, registered for the offence punishable under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. 2. Heard Sri M.R.K.Chakravarthy, learned Counsel for the petitioner and learned Assistant Public Prosecutor representing the respondent-State. 3. It is the case of the prosecution that the owner of the premises near to which the dead body of the deceased was found lodged a report with the police. During the course of investigation, in the CCTV footage, the movements of the accused were allegedly noted. The prosecution further relies upon the alleged confession of the accused and other material collected during the investigation to establish his involvement in the commission of the crime. 4. Learned counsel for the petitioner would submit that the petitioner is innocent and the entire case rests on circumstantial evidence. Learned counsel further submits that the investigation has been completed and charge sheet is also filed. There are no criminal antecedents or previous involvement in any offence has been attributed to the petitioner. The confession made before police by the accused is negligible and in view of completion of 3 investigation and filing of charge sheet, the petitioner is entitled to be enlarged on bail. 5. Learned Assistant Public Prosecutor would submit that charge sheet is filed. 6. Considering the facts and circumstances of the case, the fact that investigation has been completed and filing of charge sheet is evident, necessity of petitioner in jail is not found. Therefore, this Court is inclined to enlarge the petitioner on bail. 7. In the result, the Criminal Petition is allowed with the following conditions: i. The Petitioner/Accused shall be enlarged on bail on executing bond for a sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties for the like sum each to the satisfaction of the learned Chief Judicial Magistrate at Vijayawada. ii. The Petitioner/Accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the prosecution evidence. iii. The petitioner/accused shall not leave the jurisdiction concerned without prior permission of the Court, if so directed by the trial Court. iv. The Petitioner/Accused shall not indulge in similar acts of crime. 4 v. The Petitioner/Accused and his sureties shall furnish their permanent residential address details and identity particulars to the concerned police and keep the Police informed about the change in address, if any, time to time. vi. The Petitioner/Accused shall scrupulously comply with the above conditions, and breach of any of them will be viewed seriously.
