JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question registration of a crime in crime No.197/2025 registered for the offences punishable under Sections 316(2), 318(4), 336(2), 351(2), 352, 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Heard Sri. Shankar H.S., learned counsel appearing for the petitioners, Sri. Anoop Kumar, learned High Court Government Pleader appearing for respondent No.1, Sri. Krishna Kumar K.K., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT FILED BY PETITIONERS & RESPONDENT NO.2 We, Mr. Nanjundaiah, S/o Late Ramaiah, aged about 49 years, residing at No. 32/245/1, Channabasavadevaru Layout, Adde Vishwanathapura Road, Rajanukunte, Bengaluru 560064; Smt. Lavanya - 4 - HC-KAR NC: 2026:KHC:16260 CRL.P No. 2555 of 2026 R,W/o Nanjundaiah, aged about 40 years, residing at No. 32/245/1, Channabasavadevaru Layout, Adde Vishwanathapura Road, Rajanukunte, Bengaluru 560064; and Mr. Mohan Kumar T, S/o Late Thayanna, aged about 40 years, residing at No.69, O.B. Choodahalli, Udayapura Post, Kanakapura Main Road, Bengaluru 560082; do hereby solemnly affirm and state on oath as follows: 1. We state that the Deponents No.1 and 2 are the Petitioners/Accused Nos.1 & 2 and the Deponent No.3 is the Complainant/Respondent No.2 in Crime No.197/2025 registered by Nelamangala Town Police Station. We are well acquainted with the facts and circumstances of the case and are competent to swear to this affidavit. 2. We further state that Deponent No.3 (Complainant) is a close relative of the Petitioners, and the dispute between the parties has arisen out of inter se family and financial transactions. We further submit that the dispute pertains to transactions relating to immovable property, development of sites and sharing of sale consideration, and the same is essentially civil and personal in nature. 3. We state that, with the intervention of elders, well- wishers and respectable members of the community, the parties have amicably settled the entire dispute and have resolved all their differences in a cordial manner. 4. Deponent No.3 (Complainant) hereby categorically states that he has no objection whatsoever for quashing of the FIR in Crime No. 197/2025, insofar as it relates to the Petitioners/Accused Nos.1 & 2. 5. We further state that the settlement entered into between the parties is voluntary, lawful and has been arrived at without any coercion, undue influence, threat or compulsion from any quarter. 6. We submit that the dispute between the parties does not involve any element of public interest and is purely private in nature. The alleged offences are not offences against the State or society at large, and therefore continuation of the criminal proceedings would serve no useful purpose. - 5 - HC-KAR NC: 2026:KHC:16260 CRL.P No. 2555 of 2026 7. We state that continuation of the FIR and further investigation in Crime No. 197/2025 would amount to abuse of the process of law and would cause unnecessary hardship, prejudice and mental agony to the Petitioners. 8. In view of the amicable settlement arrived at between the parties, we respectfully submit that this is a fit case for exercise of inherent powers of this Hon'ble Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to secure the ends of Justice. 9. We, the deponents, do hereby solemnly affirm and state that the contents of this affidavit are true and correct to the best of our knowledge, information and belief." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. The learned counsel appearing for the petitioners would submit that the original documents are seized by the Investigating Officer. 6. In the light of the settlement arrived at between the parties and the quashment of the proceedings, the documents - 6 - HC-KAR NC: 2026:KHC:16260 CRL.P No. 2555 of 2026 that are seized shall be handed over to the holder of the documents in accordance with law without brooking any delay. 7. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. (ii) Registration of a crime in crime No.197/2025 pending on the file of II Additional Civil Judge and JMFC, Nelamangala, against the petitioners stands quashed.
