Mr. Brijendra Pratap Singh Mr. Asit Kumar De … for the State 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to consider the intra-district transfer application of the petitioner submitted through online, i.e., “Utsashree” portal. 3. The petitioner contends that he joined as an Assistant Teacher in Amanidanga Adi-Basi Free Primary School under Burdwan District Primary School Council (presently known as Paschim Bardhaman District Primary School Council) on 16th July, 2010. Subsequently, the petitioner has been transferred to Banagram Adibasi Free Primary School of Kanksa, District Paschim Bardhaman, where he joined in the month of September, 2011. The petitioner is confirmed 2 in service with effect from 16th July, 2012. On 12th August, 2022 the petitioner submitted an application through “Utsashree” portal seeking for his transfer on distance ground. Though the transfer was approved but the same could not be effected since the petitioner did not produce/annex the confirmation letter. Hence this writ petition for appropriate orders. 4. Mr. Sudip Ghosh Chowdhury, learned Advocate appearing on behalf of the petitioner submits that liberty be granted to the petitioner to submit the confirmation letter to the concerned District Primary School Council for further course of action. 5. Mr. Brijendra Pratap Singh, learned Advocate representing the State leaves the matter to the discretion of this Court. 6. In view of such submission, liberty is granted to the petitioner to submit his confirmation letter before the concerned Council within a period of four weeks from date. Upon such submission of the confirmation letter by the petitioner, the concerned District Primary School Council will take further steps, in accordance with law with regard to application submitted by the petitioner through “Utsashree” portal seeking transfer, within a period of six weeks thereof. 7. With the above direction, the writ petition being WPA 29450 of 2025 stands disposed of. 8. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 9. Interim order, if any, stands vacated. 3 10. All connected applications, if any, stand disposed of. 11. There shall be no order as to costs. 12. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 13. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
