Brief facts of the case are that the victim lodged a report alleging that on 17.01.2026, at about 11:00 a.m., while she had gone to the forest to collect firewood, the present Applicant approached her and forcibly committed rape upon her. It is further alleged that when the victim raised an alarm, the Applicant gagged her by covering her mouth with a cloth and threatened to kill her. Accordingly, offences as mentioned above have been registered against the present Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that the statement of the victim, who is a married woman, has already been recorded before the trial Court. It is submitted that while she supported the prosecution case in her examination-in-chief, during cross- examination she made admissions which do not support the prosecution case. He lastly submits that the Applicant is in custody since 18.01.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail 3 application and submits that the FSL report has not yet been received. 5. Considering the submissions advanced by learned Counsel for the parties, the nature of allegations, the material available in the case diary, the specific allegation against the present Applicant, the fact that he is named in the FIR, the statement of the prosecutrix recorded under Section 183 of the BNSS wherein she has also alleged that the Applicant committed rape upon her and the fact that she has supported the prosecution case in her examination-in-chief and without further commenting anything on the merits of the case, this Court is not inclined to grant bail to the present Applicant. 6. Accordingly, the bail application of the applicant – Ramjeet involved in Crime No.08/2026 registered at Police Station – Basantpur, District- Balrampur-Ramanujganj (C.G.), for the offences under Sections 64(1) and 351(2) of BNS is hereby rejected. 7.
