Learned counsel for the petitioner submits that the charge in the connected case has been framed as back as on 11.03.2024, but no witness has been examined so far. The opposite party-CBI has filed a counter- affidavit in this case admitting the aforesaid position. There are altogether 78 charge-sheet witnesses and there is no likelihood of conclusion of the trial in near future. It is alleged that the petitioner, through his company, collected a sum of Rs. 29,61,700/- from the investors by way of Recurring Deposits, Fixed Deposits, Monthly Income Schemes, etc. 3. Learned counsel for the opposite party-CBI has opposed the prayer for bail and has submitted that the petitioner is involved in approximately five cases of similar nature, four of which are in the State 2026:JHHC:29090 2 of Jharkhand and one in the State of Odisha. The learned counsel submits that the petitioner ought to have suo-moto disclosed the criminal antecedent, for which, the learned counsel has referred to the judgment passed by the Hon’ble Supreme Court in the case of Munnesh vs. State of U.P. reported in 2025 SCC OnLine SC 1319, paragraph 12 and 13. The learned counsel has further submitted that the allegations against the petitioner are very serious and he has siphoned off the public money. 4. With respect to non-production of witnesses, the learned counsel for the opposite party-CBI has submitted that the CBI is ready to produce the witnesses and necessary summons have already been issued, but the fact that no witness has been produced so far is not in dispute. 5. To this, learned counsel for the petitioner submits that there is no likelihood of the petitioner tampering with any evidence and therefore he may be enlarged on bail. 6. After hearing the learned counsel for the parties and considering the custody of the petitioner since 05.02.2024 and the fact that the charge has already been framed as back as on 11.03.2024, but no witness has been produced before the learned court so far and there are numerous witnesses to be examined , the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM-cum-Special Judicial Magistrate, CBI, Dhanbad in connection with FIR being RC093201750012 corresponding to RC 12(S)/2017/EOW/Ranchi, subject to the following conditions: - (i) The petitioner will deposit his passport before the learned court.
