06/01.04.2026 Heard Ms. Divya, learned counsel for the petitioner and Mr. Deepankar, learned A.C. to G.A.-III for the respondents. In this writ application, a direction has been sought for upon the respondent nos. 2 and 3 to enforce the orders passed by the learned trial court pertaining to Adityapur P.S. Case No. 199 of 2016 as the respondents have failed to apprehend the accused persons in connection with the said case. It has been submitted by the learned counsel for the petitioner that though Adityapur P.S. Case No. 199 of 2016 was instituted in the year 2016 against the builders by the petitioner who is the land owner but an order of stay was passed in Cr.M.P. No. 1829 of 2017 which was a cause for not apprehending the accused persons. Learned counsel for the petitioner submits that though the said application has been dismissed as withdrawn vide order dated 03.07.2024 and despite the efforts made by the learned trial court to ensure appearance of the accused persons the respondent nos. 2 and 3 are sitting tight over the matter. Mr. Deepankar, learned A.C. to G.A.-III for the respondents has submitted that efforts are being taken to ensure appearance of the accused persons. Since the learned trial court is in seisin of the matter and efforts are being taken by the learned trial court to ensure the appearance of the accused persons the petitioner can very well avail his remedy before the concerned court. In view of the prayer made in this writ application and the background facts and circumstances of the case and the remedy available to the petitioner as indicated above, I am not inclined to entertain this writ application which accordingly stands disposed of.
