PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To enlarge the petitioner on bail in Spl.S.C.No.53 of 2022 on the file of the learned Special Court for Protection of Children from the Sexual Offences Act, Kanniyakumari District at Nagercoil in Crime No.07 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole accused is facing trial in Spl.S.C.No.53 of 2022 on the file of the learned Special Court for Protection of Children from the Sexual Offences Act, Kanniyakumari District at Nagercoil, for the offence under Sections 6(1), 5(l) and 5(m) of POCSO Act in Crime No.07 of 2022, on the file of the respondent police. Since the petitioner failed to appear before the trial Court, a Non-Bailable Warrant (NBW) came to be issued against him on 18.06.2025 and that the warrant was executed on 15.10.2025 and he has been in judicial custody. No.9971 of 2026 2.When the matter is taken up for hearing, the learned Counsel for the State of Tamil Nadu (Criminal side) would submit that on account of the petitioner's non-appearance before the trial Court, a Non-bailable Warrant came to be issued on 18.06.2025 and the same was executed and the petitioner was arrested on
15.10.2025. He would further submit that the prosecution has already examined nine witnesses and that the case stands posted on 03.06.2026 for the examination of the Investigating Officer and the Medical Officer. 3.The learned counsel for the petitioner would submit that the petitioner has been in judicial custody since 15.10.2025 and that he would co-operate for the completion of the remaining part of the trial. 4.Considering the facts and circumstances of the case, particularly the fact that nine out of the eleven prosecution witnesses have already been examined and that the case is at the 3/6 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.9971 of 2026 fag end of the trial, this Court is of the view that the ends of justice would be met by directing the trial Court to conclude the proceedings within a time frame. 5.Accordingly, the learned Special Court for Protection of Children from Sexual Offences Act Cases, Kanniyakumari District at Nagercoil, is directed to complete the trial and dispose of Spl.S.C.No.53 of 2022, as expeditiously as possible and, in any event, within a period of six weeks from the date of receipt of a copy of this order. 6.With the above direction, this Criminal Original Petition is
