Civil revision has been preferred praying for transfer of Title Suit no. 2159 of 2022 pending before the Learned 4th Bench, City Civil Court at Calcutta to the Hon’ble High Court at Calcutta, Original Side, Commercial Division. 2. Admittedly, there is a Commercial Court which functions in the City Civil Court, Calcutta and the said court is under the administrative control of the Chief Judge, City Civil Court. 3. Learned counsel for the petitioner submits that the Title Suit was instituted in the year 2022 and now considering the nature of dispute in the said suit, the same is to be tried by a Commercial Court. As such the petitioner prays for transfer of the records to the Commercial Decision of the High Court. It is further submitted that the Commercial Court under the City Civil Court does not have the pecuniary jurisdiction to consider the matter. 4.On hearing the learned counsel for the petitioner, the civil revision is disposed of with liberty granted to the petitioner to approach the Court of the learned Chief Judge, City Civil Court, Calcutta by filing an application praying for such transfer, which the Learned Judge, City Civil Court, Calcutta shall consider in accordance with law. 5.Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
