ORAL ORDER
This writ petition is filed challenging the judgment and
order dated 24.04.2026 passed by the learned Additional City Civil and Sessions Judge, Bengaluru (for short, "the Trial

Court"), in O.S.No.2886/2026 passed on I.A.Nos.1 and 2 under
Order XXXIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908 whereby an ex-parte ad-interim order of temporary injunction was granted.

Learned counsel for the petitioners submits that no reasons have been assigned by the Trial Court for passing the exparte order of injunction and, therefore, the present writ petition has been filed.
3. However, upon perusal of the impugned order, it is seen that the Trial Court has discussed certain aspects relevant to the grant of an exparte temporary injunction. According to the petitioner, the reasons assigned may not be sufficient, the
order does contain certain observations and reasons indicating why the Trial Court considered it appropriate to grant the ex parte temporary injunction.
4. In cases where an exparte injunction order has been passed, the appropriate remedy is to seek regularisation of the order under Order XXXIX Rule 4 of the Code of Civil Procedure. In the present case, since some reasons have been assigned by the Trial Court while granting the ex parte

injunction, this Court is not inclined to interfere in exercise of its writ jurisdiction.
5. Accordingly, the writ petition is disposed, reserving liberty to the petitioner to file an appropriate application under
Order XXXIX Rule 4 of the Code of Civil Procedure before the Trial Court.
6. It is submitted that the matter is posted before the Trial Court on 24.04.2026. In the event the petitioner files such an application, the Trial Court shall, after receiving objections from the respondent, consider and dispose of the application expeditiously, preferably within a period of two weeks. Till a decision is taken on the application filed by the petitioner, the operation of the impugned order shall remain suspended. Accordingly, the writ petition is disposed off.
