JUSTICE E.S.INDIRESH ORAL ORDER In this petition, petitioners are challenging the order dated 14th December, 2022 (Annexure-S) passed by the respondent No.2 in Case No.RA(BN)207/2020. 2. Heard Sri. Abhinay Y.T., learned counsel appearing for the petitioner; Sri. A.S. Harish, learned Additional Government Advocate appearing for respondents 1 to 3; Sri. Harish Kumar M.S., learned counsel appearing for the respondent No.4; Sri. M. Vasudeva, learned counsel appearing - 5 - HC-KAR NC: 2026:KHC:34999 WP NO.17127 OF 2023 for respondents 8, 17 and 18; and Sri. Supreeth S., learned counsel appearing for the respondent No.6. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned order dated 14th December 2022 (Annexure-S), it is forthcoming that the respondent No.2 had remitted the matter to the respondent No.3 for reconsideration afresh in Case No.RRT(D)33/2014-15, in compliance with the direction issued in R.A.(BN)No.180/2012-13. Taking into consideration the fact that, already an order has been passed by the respondent No.3 as to the mutation entries in the revenue records in respect of the subject land, so also, the subject matter in Original Suit No.287/1980 is nothing to do with the issue involved in the present petition, I am of the view that the impugned order passed by the respondent No.2 requires to be set-aside and matter be remitted back to the respondent No.2 to reconsider the issue afresh. It is also pertinent to mention here that, parties are at liberty to bring the legal representatives of the deceased, if any, under the circumstances of the case. - 6 - HC-KAR NC: 2026:KHC:34999 WP NO.17127 OF 2023 4. Accordingly, order dated 14th December, 2022 (Annexure-S) passed by the respondent No.2 in Case No.R.A.(BN)207/2020 is hereby set-aside. The matter is remitted back to the respondent No.2 to reconsider the issue afresh and take decision, after affording an opportunity of hearing to all the parties concerned. 5. Taking into consideration the fact that the RRT proceedings is of the year 2012-13, in order avoid further delay in the matter, parties are directed to appear before the respondent No.2 on 17th August, 2026 at 03.00 p.m. and the respondent No.2 shall complete the entire proceedings at the earliest, in any event, within a period of six months from the date of appearance of the parties.
