1. Mr. Aditya Singh, learned counsel for the applicant.
2. Mr. G.S. Sandhu, learned Addl. Advocate General with Mr. Himanshu Sain, learned A.G.A. for the State.

This is the second bail application moved on behalf of the present applicant, namely, Abbas alias Dr. M.A. Rahul, S/o Abdul Gaffar seeking bail in relation to FIR dated 22.09.2025, bearing FIR No. 417 of 2025 registered at P.S. Kashipur District Udham Singh Nagar, which was lodged against three persons implicated them for the offences punishable under Sections 191(2), 191(3), 121(1), 132, 221, 352, 351(2), 324(3), 190, 196(c) and 109 of BNS 2023 read with Section 7 of Criminal Law Amendment Act.
4. The first bail application was rejected by this Court on 17.10.2025.

Learned counsel for the applicant argued that the charge sheet has already been filed on 17.12.2025 that too after rejection of the first bail application and most of the accused persons have already been enlarged on bail. He also submits that the present applicant is languishing in jail since 24.09.2025 and have no previous criminal antecedents.
6. On the other side, Mr. G.S. Sandhu, learned Addl. Advocate General for the State has not disputed this fact that after rejection of first bail application the charge sheet has been filed and the applicant is
2026:UHC:2108 languishing in jail since 24.09.2025. He has also not disputed that the other co- accused have already been enlarged on bail by this Court, however, Mr. G.S. Sandhu pointed out that in respect of certain issues the investigation is still going on.
7. No doubt the investigation in respect of certain issues is going on but it does not mean that the applicant does not deserve for bail particularly when he is languishing in jail since 24.09.2025 and charge sheet has already been filed.
8. Accordingly, without expressing any opinion on the merit of the case, the instant second bail application is allowed.
9. Let the applicant “Abbas alias Dr. M.A. Rahul” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
10. It is made clear that after being released on bail the applicant shall cooperate with the investigating agency in respect of the further investigation, which is still going on in respect of certain more issues.
