Kausik (Rejected) CRM (NDPS) 881 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhatar Police Station Case No. 263 of 2025 dated 06.07.2025 under Sections 20(b)(ii)(C)/25/29 of the NDPS Act. And In the matter of : Rajat Bahadur Sonar ……Petitioner. Mr. Uday Sankar Chattopadhyay Ms. Sadia Parveen ……for the Petitioner. Mr. L. Vishal Kumar ……for the State. Learned advocate appearing for the petitioner submits that the accusation against the petitioner is, he was driving a vehicle and from underneath his seat 41 Kgs. of Ganja were recovered. Petitioner is in custody for more than a year and although charge sheet submitted but witness action has not commenced. Learned advocate for the State has opposed the prayer for bail as commercial quantity of contraband has been seized. Having regard to the rigors of Section 37 of the NDPS Act is attracted, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 881 of 2026 is dismissed. 2 Learned Special Court is directed to prepone the examination of the independent witnesses (CSW 9 and CSW 10). The same be concluded preferably within a period of 4 months from the date of communication of this order. Petitioner would renew his prayer for bail after the evidence of the aforesaid two seizure list witnesses are over. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
