This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant, who is apprehending his arrest in connection SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.03.17 14:53:08 +0530 2 with Crime No.171/2026 registered at Police Station –Civil Lines, Bilaspur (C.G.) for the offence punishable under Sections 62(2)(m), 69, 296 and 351(2) of BNS, 2023. 2. According to prosecution story, on 01.02.2026, the victim lodged a written complaint at Police Station Civil Line, Bilaspur, alleging that in the month of June 2025 she came in contact with the present Applicant through Instagram. It is alleged that after repeated friend requests claiming that they belonged to the same caste, she accepted the request and they started conversing regularly. During the course of conversation, the Applicant allegedly proposed marriage. Thereafter, on 25.10.2025 the Applicant called her to Agrasen Chowk, Bilaspur and after booking a room in a hotel, allegedly established physical relations with her for two days on the pretext of marriage, due to which she became pregnant. It is further alleged that when she informed the Applicant about her pregnancy, he gave her abortion pills causing miscarriage and subsequently refused to marry her. Based on these allegations, the aforesaid offence has been registered against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present 3 case. It is further submitted that the victim is a major lady, the relationship between the parties was consensual and the present FIR was lodged just because the Applicant has refused to marry the victim. He lastly submits that conclusion of trial is likely to take quite some time for its conclusion, therefore, the present Applicant may be granted anticipatory bail. 4. On the other hand, learned Counsel for the State and the Objector oppose the prayer for grant of anticipatory bail. 5. Considering the submissions made by learned Counsel for the parties, the facts and circumstances of the case and further considering that the victim is a major lady, she was a consenting party and a false FIR was lodged against the Applicant just because of his refusal to marry her, without further commenting anything on the merits of the case, this Court is inclined to allow the anticipatory bail application. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Yogendra Dirhe, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant/s shall not directly or indirectly make any inducement, threat or promise to any person 4 acquainted with the facts of the case so as to dissuade him/her/them from disclosing such fact to the Court. (b) The Applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant/s shall appear before the trial Court on each and every date given to him/her/them by the said Court till disposal of the trial. (d)The Applicant/s and the surety shall submit a copy of his/her/their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
