Affidavits of service filed in Court are taken on record. 2. The instant appeal is directed against the judgment and order dated 12th July, 2024 passed by the Single Bench of this Court whereby the Single Bench disallowed the writ petitioners to deposit the amount of CPF together with interest for giving effect to the option exercised by their late husbands for conversion from CPF to GPF. 3. It further appears that several communications were made to the writ petitioners right from 2012, 2013 and 2015 to 2 come forward to make the refund-in-question together with interest and penalty. For the first time, the writ petitioners replied to the Authorities on 3rd May, 2024 that they could not make the refunds earlier due to financial constraint. 4. The petitioners have therefore admitted deliberate and willful inaction on their part to make deposit of their husbands’ contribution to the CPF together with interest from the year 2015 for a period of nearly 9 years thereafter. 5. In the backdrop of the above, this Court does not find any reason to interfere with the order of the Single Bench disallowing the writ petitioners to refund the government contribution of CPF together with interest. 6. For the reasons stated herein above, all the appeals fail and are hereby dismissed. Consequently all pending connected applications, if any, are also dismissed. 7. Any amount of gratuity payable to the petitioners on account of their husbands’ service that has not been paid till date, to be paid by the respondents to the petitioners, together with interest @ 6 per cent per annum 3 within a period of two months from the date of communication of a copy of this order. 8. There will be no order as to costs. 9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
