City Civil & Sessions Judge, Bengaluru, arising out of Crime No.58/2026 registered by Govindapura Police Station, Bengaluru City, for the offences punishable under Sections 506, 376 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.58/2026 was registered by Govindapura Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 19.02.2026 received from the alleged victim aged about 33 years. In the said case, petitioner was arrested on 20.02.2026 and was remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.4277/2026 was rejected on 18.05.2026. Perusal of the material on record would go to show that the victim is a married lady and petitioner is her husband's friend. The allegation against the petitioner is that on 20.11.2023 at about 12.30 p.m., petitioner who came to the house of the victim, allegedly committed forcible sexual assault on her, and thereafter, threatened her with dire consequences. In respect of the alleged incident that had taken place on 20.11.2023, first information is belatedly filed on 19.02.2026 which is after a period of more than two years. Investigation of the case is completed and charge sheet is filed. The submission of the learned Counsel for the petitioner that petitioner has no other criminal antecedents, is not seriously disputed by the learned HCGP. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.731/2026 pending before the Court of LIII Addl. City Civil & Sessions Judge, Bengaluru, arising out of Crime No.58/2026 registered by Govindapura Police Station, - 4 - HC-KAR NC: 2026:KHC:34910 CRL.P No. 7564 of 2026 Bengaluru City, for the offences punishable under Sections 506, 376 of IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
