BY ITS VILLAGE SECRETARY, TSUNDURU MANDAL, BAPATLA DISTRICT - 522318. ...RESPONDENT(S): Counsel for the Petitioner: 2 Dr. YLR, J W.P.No.14786 of 2026 Dated 28.05.2026 AYESHA AZMA S Counsel for the Respondent(S): GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering with and attempting to high handedly dispossess the petitioner from agricultural land admeasuring Ac. 2- 00 cents in Sy No .642/1-1 B situated at Karumurivari Palem Village Tsunduru Mandal Bapatia District and their highhanded claim that permission is being granted for carrying out mining/excavation activity in the said land without issuing any notice without conducting enquiry and without following due process of law as illegal arbitrary high handed unconstitutional and violative of Articles 14, 21 and 300A of the Constitution of India and consequently direct the any respondents not to interfere with the petitioners peaceful possession and enjoyment of the subject land and not to permit or undertake any mining excavation levelling or dispossession activity therein except by following due process of law….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 3. The learned counsel for the petitioner submits that the respondents have been interfering with the peaceful possession and enjoyment of the subject land by the petitioner and are attempting to dispossess the petitioner from the subject land without following due process of law. 4. Mr.T.Sanjeeva Rao, learned Assistant Government Pleader for Revenue, on written instructions, submits that the documents relied upon by 3 Dr. YLR, J W.P.No.14786 of 2026 Dated 28.05.2026 the petitioner are fake and do not match with the revenue records. It is further submitted that, pursuant to the orders passed by this Court in W.P.No.4163 of 2026, the Gram Panchayat, Karumurivaripalem, is taking steps to evict the petitioner, who is alleged to have encroached upon the land in Sy.No.642/1 of Karumurivaripalem Village, by following due process of law. 5. Be that as it may, the petitioner cannot be dispossessed by the respondents without following due process of law. The respondents shall conduct a detailed enquiry by verifying the documents relied upon by the petitioner and may thereafter pass appropriate orders and take steps for eviction by following due process of law. Until such time, the respondents shall not dispossess the petitioner from the subject land. 6. Having regard to the entire facts and circumstances of the case, the writ petition is disposed of directing the respondents not to interfere with the peaceful possession and enjoyment of the subject land of the petitioner without following due process of law. 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
