GP FOR IRRI AND CAD The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents herein particularly Respondent 3 and 4 in making efforts to remove the Syphons at the agriculture lands of the petitioner situated at Survey No. 109/1 of Gorinta village Peddapuram Mandal Kakinada District Erstwhile East Godavari district without having on the influence of any right or authority and without issuing any notice Respondent No. 5 as nothing but illegal arbitrary erroneous and violative of Article 14, 21, 300A of the Constitution of India and consequently directing the respondents not to interfere with the Petitioners peaceful possession and enjoyment of the land situated at Survey No. 109/1 of Gorinta village Peddapuram Mandal Kakinada District Erstwhile East Godavari district and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Irrigation Department. 3. Mr. A.K. Kishore Reddy, learned counsel for the petitioner, submits that respondent Nos.3 and 4 are making efforts to remove the syphons situated in the agricultural land of the petitioner without any authority of law and without issuing any notice, at the instance of respondent No.5. 3 Dr. YLR, J W.P.No.14894 of 2026 Dated 28.05.2026 4. Mr. M. Ratna Kumar, learned Assistant Government Pleader for Irrigation Department appearing for respondent No.4, submits that respondent No.4 has not been interfering with the peaceful possession and enjoyment of the land situated in Sy.No.109/1 of Gorinta Village, Peddapuram Mandal, Kakinada District. 5. Considering the entire facts and circumstances of the case, and recording the submissions made by the learned Assistant Government Pleader appearing for respondent No.4, the writ petition is disposed of directing respondent Nos.3 and 4 not to interfere henceforth with the peaceful possession and enjoyment of the land of the petitioner situated in Sy.No.109/1 of Gorinta Village, Peddapuram Mandal, Kakinada District, without following due process of law. 6. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
