Accused No.6 in Crime No.9/2026 registered by Keragodu Police Station, Mandya, for the offences punishable under Sections 61(2)(a), 332(b), 103(1), 351(2), 249, 238 and 329(4) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.9/2026 was registered by Keragodu Police Station, Mandya, for the offences punishable under Sections 61(2)(a), 332(b), 103(1) and 3(5) of BNS, 2023, against one Ningaraju and others based on the first information dated 16.01.2026 received from Kempegowda, brother of deceased Yogesh. In the said case, petitioner was arrested on 19.02.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed against nine persons and petitioner is arraigned as accused No.6 in the charge sheet. His bail application filed before the Trial Court in Crl.Misc.No.370/2026 was rejected on 13.05.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:34823 CRL.P No. 7251 of 2026 4. Material on record would go to show that petitioner's name is not found in the FIR. It appears that incident in question had taken place in the background of a dispute between the family members of the two parties, who are relatives. Insofar as petitioner is concerned, allegation as against him is that he had harbored the accused persons, who had committed the crime and also helped them to destroy the evidence. There is no allegation as against him in participating in the incident that had taken place on 16.01.2026, in which Yogesh, was assaulted and murdered. He is in custody in the present case from 19.02.2026. Investigation of the case is completed and charge sheet has been filed. Under the circumstances, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.9/2026 registered by Keragodu Police Station, Mandya, for the offences punishable under Sections 61(2)(a), 332(b), 103(1), 351(2), 249, 238 and 329(4) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the - 4 - HC-KAR NC: 2026:KHC:34823 CRL.P No. 7251 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
