Accused No.3 in Crime No.60/2026 registered by Belthangadi Police Station, Dakshina Kannada District, for the offences punishable under Sections 74, 75(2) read with 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of the respondent State. 3. FIR in Crime No.60 of 2026 was registered by the Belthangadi Police Station, Dakshina Kannada District for the aforesaid offences against one Altaf and others, based on the first information, dated 20.05.2026 received from victim girl, aged 21 years. In the said case, petitioner was arrested on 20.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR NC: 2026:KHC:35222 CRL.P No. 9789 of 2026 Crl.Misc.No.501 of 2026 was rejected on 23.06.2026. Therefore, he is before this Court. 4. Accused nos.1 and 2 had approached this Court in Criminal Petition No.8789 of 2026 seeking regular bail. This Court, vide order dated 06.07.2026 has allowed the said petition. In paragraph number 4 of the said order, it is observed as follows: "Perusal of the material on record would go to show that the accused persons named in the FIR and the alleged victims are all acquainted to each other and they had together traveled in a car to a water falls within the jurisdiction of Belthangadi Police Station. The allegation against the accused persons is that when the victims were playing in the water, the accused persons allegedly inappropriately touched them and also tried to outrage their modesty. Considering the nature of allegations found in the first information and also taking into consideration that the petitioners are now in custody, I am of the opinion that their prayer for grant of regular bail is required to be answered affirmatively". 5. Under the circumstances, I am of the opinion, even the petitioner has made out a case for grant of regular bail. 6. Accordingly, following :- - 4 - HC-KAR NC: 2026:KHC:35222 CRL.P No. 9789 of 2026 ORDER The petitioner is directed to be enlarged on bail in Crime No.60/2026 registered by Belthangady Police Station, Dakshina Kannada District, for the offences punishable under Sections 74, 75(2) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
