The petitioner is a member of Alinagar Gram Panchayat and submitted a no confidence motion for removal of the Pradhan and Upa Pradhan of the Panchayat alongwith other members before the Prescribed Authority. The petitioner’s name has been deleted from the Voters’ list in Special Intensive Revision. She approached the Block Development Officer, Kaliachak-I Block by a letter dated 29th June, 2026 seeking clarification whether she was eligible to participate in the meeting scheduled on 14th July, 2026 by the Prescribed Authority for consideration of the motion. The Block Development Officer informed the petitioner by a letter issued on 30th June, 2026 that the matter was sent to the District Panchayat and Rural Development Officer, Malda seeking clarification. 2 The petitioner seeks a direction upon the authority to clarify the position so that she is able to cast her vote in the meeting fixed on 14th July, 2026. In view of the above, this Court is inclined to hold that since the meeting pertaining to the no confidence motion has been fixed by the Prescribed Authority on 14th July, 2026, the District Panchayat and Rural Development Officer, Malda, being the 7th respondent herein, is directed to take a decision in terms of the letter submitted by the Block Development Officer on 30th June, 2026 within 13th July, 2026 so that the petitioner is aware of her rights in respect of the motion. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
