Rahaman …for the Petitioner Mr. Subir Ganguly Mr. Sandeep Prasad Shaw …for the State In this application, the petitioner herein is aggrieved by the order dated 7.1.2020 passed by the learned Additional Chief Judicial Magistrate, 2nd Court, Haldia in G.R. case no. 585 of 2015. By the impugned order, learned court below had issued warrant of arrest against the present petitioner. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the petitioner appeared before the court below on various dates but unfortunately, he could not appear on the date fixed due to communication gap and his appointed lawyer failed to take proper steps and for which, the court below had issued warrant of arrest against him. However, learned counsel for the petitioner on instruction submits that a liberty may be given to the petitioner so that he may surrender before the court below. Having heard learned counsel for the petitioner, the instant application being CRR 943 of 2026 is hereby disposed of by giving liberty to the petitioner to surrender before the court below within a fortnight and in the event of such surrender, the court below will dispose of his prayer in 2 accordance with law without being influenced by any observations made herein.
