Toor, AAG, Punjab. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 BNSS is for the grant of regular bail to the petitioner in cross case i.e. G.D. No.28 dated 28.03.2021 (Annexure P-2) and the challan presented under Section 323, 294, 302, 325, 148 and 149 of IPC, 1860 in FIR No.42 dated 28.03.2021 under Section 323, 324, 294, 148 and 149 IPC (later on added offence u/s 326 of IPC) registered at Police Station Naya Gaon, District SAS Nagar. 2. The learned counsel for the petitioner contends that all the material witnesses have turned hostile. As the petitioner is in custody since 30.07.2025 but only 08 of the 21 prosecution witnesses have been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, the petitioner is entitled to the concession of regular bail. VISHAL SETHI 2026.07.09 11:04 I attest to the accuracy and integrity of this document ::2:: 3. The learned counsel for the State, on the other hand, has not disputed the factual assertion that all the material witnesses have turned hostile and that the petitioner is in custody since 30.07.2025 but only 08 of the 21 prosecution witnesses have been examined so far. 4. I have heard the learned counsel for the parties. 5. Admittedly, all the material witnesses have turned hostile. Whether the remaining evidence is sufficient to establish the culpability of the petitioner shall be adjudicated upon during the course of the Trial. The petitioner is stated to be in custody since 30.07.2025 but only 08 of the 21 prosecution witnesses have been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 6. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Subrati @ Subrati Ansari is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7. The petition stands disposed of.
