Chatterjee Ms. Aparna Das …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the Learned Civil Judge (Junior Division) at Bidhannagar, to dispose of the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure filed by the opposite party and the application under Order 39 Rule 4 of the Code of Civil Procedure filed by the petitioner in Title Suit No. 13 of 2024, expeditiously. The learned Advocate appearing for the petitioner submits that the aforesaid applications are otherwise ready for hearing. From the order-sheet appended to these applications, this Court finds that 15th July, 2026 has been fixed for hearing of the injunction application and the application under Order 39 Rule 4 of the Code of Civil Procedure. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), Bidhannagar to take up the hearing of the application for injunction and the application under order 39 Rule 4 of the Code of Civil Procedure on the next date of hearing i.e. on 15th July, 2026, if the same are otherwise ready for hearing and make all endeavour to dispose of the same as expeditiously as possible, without granting any unnecessary adjournments to either of the parties. After disposal of the aforesaid applications and any other interlocutory application(s) that may be pending, the learned Trial Judge shall make all endeavour to dispose of the Title Suit No. 13 of 2024 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
