The present is a writ petition filed by the petitioner under under Article 227 of the Constitution of India for a limited direction to the learned Family Court to decide the application filed under Section 13(1)(b) of the Hindu Marriage Act, 1955 in Case No.53A/2023 expeditiously within a stipulated time-frame. 2. Learned counsel for the petitioner would submit that the petitioner is applicant before the learned Family Court and he is prosecuting an application under Section 13(1)(b) of the Hindu Marriage Act, 1955 which is pending since 13.03.2023 wherein issues have been framed and the affidavit under Order 18 Rule 4 of the CPC has been filed before the learned Family Court, but in absence of the respondent/non- Digitally signed by MOHAMMED AADIL KHAN Date: 2026.07.16 20:08:51 +0530 2 applicant the proceeding of the case could not be materialized and the date of hearing is being adjourned time to time. He would draw attention towards the copy of the order sheets annexed with the petition at page No.10 onwards. He would further submit that since the application of the petitioner is pending since 13.03.2023, the learned Family Court may be directed to decide the same expeditiously within any stipulated time-frame. 3. I have heard learned counsel for the petitioner and perused the documents annexed with the petition. 4. Considering the limited grievance of the petitioner for direction to the learned Family Court to decide his application as early as possible within a stipulated time-frame and also in view of the order sheets of the learned Family Court, further considering that since no substantial progress has been reflected in the trial of the case, the learned Family Court is directed to decide the application of petitioner filed under Section 13(1)(b) of the Hindu Marriage Act, 1955 in Case No.53A/2023 expeditiously within a further period of five months from the next date fixed before it, in accordance with law on its own merits after providing opportunity of hearing to the parties concerned.
