Ms. Arushi Rathore along with Mr. Sayan Mukherjee, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 6 months. Charge-sheet has been submitted. The complicity of the present petitioner is only on the basis of statement co-accused, as such, he may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the quantum of recovery in the present case is more than 5 kgs. of brown sugar from a rented accommodation and a sum of Rs.1 lakh was recovered from the personal possession of 2 the present petitioner. Be that as it may, having considered the period of detention of the present petitioner and the prosecution has relied upon 11 witnesses in the charge-sheet which will take some time along with the fact that the emphasis in the present case is on the basis of statement of co-accused and a sum of Rs.1 lakh having recovered from the present petitioner, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Md. Rahim @ Rohim Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 825 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
