CRM-M-14731-2026 (O&M) -1- IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH 204 CRM-M-14731-2026 (O&M) Date of decision: 08.07.2026 Amit ...Petitioner Versus State of Haryana ...Respondent CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA Present:- Mr. Pradeep Chhoker, Advocate for the petitioner. Mr. Aditya Pal Singla, DAG, Haryana MANISHA BATRA, J. (Oral) 1. The present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) seeking grant of anticipatory bail to the petitioner in case arising out of FIR No.22 dated 09.02.2023, registered at Police Station Pinangwan, District Nuh, initially under Sections 379 and 411 IPC and subsequently under Section 136 of the Electricity Act. 2. As per the allegations in the FIR, on 09.02.2023, complainant Karim informed the police that co-accused Inderjeet had been apprehended by the villagers while allegedly stealing high-tension electricity wires from the fields of village Jharpuri. Upon his arrest, co-accused Inderjeet allegedly suffered a disclosure statement naming Vikram, Narender, Sunil and the present petitioner Amit as his accomplices. During investigation, stolen electric wire along with certain tools was recovered from the arrested accused MOHAMMAD WASEEM ANSARI 2026.07.09 09:04 I attest to the accuracy and integrity of this document CRM-M-14731-2026 (O&M) -2- persons. Subsequently, Sections 379 and 411 IPC were deleted and the case was proceeded with under Section 136 of the Electricity Act. The petitioner was not arrested during the course of investigation and has approached this Court seeking the concession of anticipatory bail after dismissal of his application by the learned Additional Sessions Judge, Nuh vide order dated 09.03.2026. 3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case on the basis of the disclosure statement of the above named co-accused, which cannot be considered to be admissible in evidence. It is further submitted that all the co-accused namely Inderjeet, Vikram, Narender and Sunil have already been granted the concession of regular bail by the competent Courts. No recovery is to be effected from the petitioner. His custodial interrogation is not required. He is ready to join the investigation. His detention would not serve any useful purpose. Hence, it is urged that the petition deserves to be allowed. 4. Status report has been filed. Learned State counsel has argued that the name of the petitioner has surfaced in this case in the disclosure statement suffered by co-accused Inderjeet with the allegations that he had actively participated in stealing the high-tension electricity wires. It is further submitted that the petitioner along with the co-accused had allegedly used an Eeco vehicle bearing registration No. HR-26BL-0903 during the commission of the offence. The custodial interrogation of the petitioner is necessary for recovery of the aforesaid vehicle and for collecting further information MOHAMMAD WASEEM ANSARI 2026.07.09 09:04 I attest to the accuracy and integrity of this document CRM-M-14731-2026 (O&M) -3- regarding the commission of the offence and the involvement of other persons. It is, therefore, prayed that the petition is liable to be dismissed. 5. This Court has heard the rival submissions. 6. The petitioner has been nominated in the present case primarily on the basis of the disclosure statement suffered by co-accused Inderjeet. Admittedly, no recovery has been effected from the petitioner nor has any incriminating article been recovered at his instance. The investigation qua the principal accused stands completed and the challan has already been presented before the trial Court. It is also not disputed that all the above named co-accused have already been granted the concession of regular bail. The status report further indicates that the petitioner is not involved in any other criminal case. At this stage, this Court is of the opinion that the custodial interrogation of the petitioner does not appear to be indispensable. Any recovery, if required, can be effected while the petitioner joins the investigation. In view thereof, the present petition is allowed. In the event of arrest, the petitioner shall be released on anticipatory bail subject to his furnishing adequate bail and surety bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation by appearing before the Investigating Officer within a period of ten days from today and further as and when called upon to do so and shall abide by all the conditions envisaged under Section 482(2) of the BNSS, 2023. It is made clear that in case the petitioner fails to cooperate with the investigation or violates any of the conditions imposed, the prosecution shall be at liberty to MOHAMMAD WASEEM ANSARI 2026.07.09 09:04 I attest to the accuracy and integrity of this document CRM-M-14731-2026 (O&M) -4- seek cancellation of the concession of anticipatory bail in accordance with law. 7. It is made clear that any observation made herein above is only for the purpose of deciding the present petition and the same shall have no bearing on the merits of the case. 08.07.2026 (MANISHA BATRA) Waseem R.
