1. Heard Mr. Ajay Pal Singh, learned counsel for the petitioner. Also heard Mr. Somya Rai, learned Deputy Government Advocate, appearing for respondents / State.
2. The petitioners have filed this petition praying for following relief:-
“I. The Hon'ble Court may kindly be pleased to allow this petition under Section 528 of B.N.S.S. filed by the petitioners. II. The Hon'ble Court may kindly be pleased to quash the impugned FIR dated 02.01.2026 bearing Crime No. 0002/2026 registered at Police Station, Mahila Thana, District- Bilaspur (C.G.), the impugned Final Report No. 08/2026 dated 16.02.2026 filed before the learned Judicial Magistrate First Class, Bilaspur, District- Bilaspur (C.G.), the cognizance taken by the learned JMFC, Bilaspur by its order dated 16.02.2026 in criminal case no. 1022/2026 and the entire proceeding of the said case which is currently under pending for trial against the petitioners under Section 85, 296, 115(2), 3(5) of Bhartiya Nyay Sanhita 2023.
3 III. The Hon'ble Court may kindly be pleased grant any other relief, which may be deemed fit in given
facts and circumstances of the case, in favour of petitioners.”

Learned counsel for the petitioner submits that the petitioner had instituted proceedings under Section 9 of the Hindu Marriage Act, 1955 seeking restitution of conjugal rights and that an ex parte decree has been passed in his favour.

However, when called upon by this Court to produce a copy of the said decree, learned counsel fairly submits that neither has the copy of the decree been filed along with the present petition nor has any averment regarding the same been made in the pleadings. The present petition has been drafted in a vague and sketchy manner without incorporating the necessary pleadings or annexing the relevant documents.
5. In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file a fresh petition after incorporating the necessary pleadings and annexing all relevant documents.
6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs.5,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Government Multi Handicapped Special School, Bagbahra, District- Mahasamund (C.G.), for wasting the precious time of this Court.
