[ Mr. Dytiman Banerjee Ms. Swagata Das …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the Learned Civil Judge (Junior Division), Haldia, Purba Medinipur, to dispose of the application under Order 39 Rule 4 filed in Title Suit No. 294 of 2022 expeditiously. The learned Advocate appearing for the petitioners submits that the application is otherwise ready for hearing. He further submits that 30th July, 2026 has been fixed for hearing of the injunction application as well as the application under Order 39 Rule 4 for the Code of Civil Procedure. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite parties forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), Haldia to take up the hearing of the application for injunction and the application under order 39 Rule 4 of the Code of Civil Procedure, if the same are otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
