KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.16 18:46:29 +0530 2 2. The prosecution case, in brief, is that co-accused Kumar Ram Thakur and his wife Sohadra Bai Thakur have induced the complainant to give money in lieu of job to his son Loknath Chouhan in Mantralaya. Thereafter the complainant gave Rs.4 lakhs cash to co-accused Kumar Ram Thakur. According to the complainant, the relatives of the complainant have also given an amount of Rs.22,70,000/- to Kumar Ram Thakur and co-accused Kumar Ram Thakur gave appointment letters to them and subsequently, they came to know that they have been cheated. Thereafter the FIR was registered against the applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. As per the FIR, there is no allegation against the applicant. Neither the applicant induced the complainant and his relatives to give money in lieu of providing job nor has he taken any amount from them. The said appointment letter has also been given by co-accused Kumar Ram Thakur to the complainant. There is inordinate delay of about 1 year in lodging the FIR. The applicant does not have any criminal antecedents. The applicant is in jail since 6.4.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant does not have any criminal antecedents and the charge 3 sheet has been submitted against the applicant. Therefore, the bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, and the fact that the charge sheet has already been submitted against the applicant, there is inordinate delay of about 1 year in lodging the FIR, the applicant does not have any criminal antecedents, the applicant is in jail since 6.4.2026 and conclusion of trial is likely to take some time, this Court is of the view that the applicant is entitled to be released on bail in the present case. 7.
