JUSTICE H.P.SANDESH ORAL JUDGMENT The appellant and the respondents along with their respective counsels are present. 2. The appellant and the respondents have filed compromise petition under Order XXIII Rule 3 of CPC praying this Court to record the compromise and pass a final decree in terms of the compromise petition. In terms of the compromise, ‘A’ schedule property is a total area of the property. The appellant has agreed to given up his right measuring east to west 20 feet and north to south 90 feet towards eastern portion, in all, measuring 1800 square feet which is marked in blue colour in the sketch out of schedule ‘A’ property which is morefully described in the schedule ‘C’ given to this compromise and the appellant is retaining the remaining portion measuring east to west 30 feet and north to south 90 - 3 - HC-KAR NC: 2026:KHC:35137 RSA No. 2670 of 2010 feet towards western portion, in all, measuring 2700 square feet which is marked in yellow colour in the sketch which is morefully descried in the schedule ‘B’ given to the compromise. The sketch is also enclosed along with this compromise petition. 3. Hence, the compromise terms are understood by the parties. In view of parties have understood the terms of the compromise, compromise petition is accepted and this appeal is disposed of in terms of the compromise arrived between the parties. 4.
