Learned counsel for the State produces the Case Diary and opposes the prayer. The petitioners are not named in the FIR. There is inordinate delay in lodging the FIR. The delay has not been duly explained. Besides the statements of the witnesses implicating the petitioners, no other document has been collected so far substantiating the same. It is a fact that the first petitioner has criminal antecedents to his credit. However, in view of the fact that the investigation has proceeded sufficiently and also in view of the material available against the petitioners in the Case Diary, this Court is inclined to 2 hold that custodial interrogation of the petitioners is not required for the purpose of investigation. They may be granted anticipatory bail. Accordingly, in the event of arrest, the petitioners namely Rajdip Singh and Badal Das @ Biswanath Das be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS and subject to further condition that they shall meet the Investigating officer once a week till submission of charge sheet.
