ORAL ORDER
Learned counsel for the petitioner submits that the petitioner is arrayed as an accused based on his voluntary statement recorded in Crime No.313/2024 registered by the very same Police Station in which the petitioner was arrested. He submits that in the present case, the petitioner's custody was not at all taken by the Police and charge sheet has already been filed.
2. At this stage, learned Additional State Public Prosecutor brings to the notice of this Court that after the charge sheet was filed, the Trial Court had issued summons to the petitioner and since, he had not appeared before the Trial Court inspite of service of summons, non-bailable warrant has

been issued against him. Therefore, anticipatory bail cannot be entertained at this stage.

Learned counsel for the petitioner submits that the petition may be dismissed as withdrawn with liberty to the petitioner to appear before the Trial Court and file necessary application seeking recall of the non-bailable warrant issued against him.
4. Said submission is placed on record.
5. Accordingly, the Criminal Petition is dismissed as withdrawn with liberty as prayed for.
6. In the event, the petitioner files such application, the Trial Court shall consider the same on merits as expeditiously as possible, but not later than a period of three days from the date of such application.
