Affidavit of service filed on behalf of the petitioners is taken on record. The Panchayat and the private respondents are not represented despite service. Learned counsel for the petitioners submits that the private respondents are raising unauthorised construction without obtaining sanction from the concerned Panchayat. In response to an application filed by the petitioners under the Right to Information Act, 2005, the Executive Assistant and State Public Information Officer, Debipur Gram Panchayat has informed that no sanctioned plan was granted in favour of the private respondents for raising construction in the plot no. 807 in Mouza Kajipara. The petitioners submitted a representation in this regard before the concerned Authority on 2nd February, 2026 which is yet to be considered. The petitioners seek consideration of the same. In view of the allegation made by the petitioners, the Pradhan, Debipur Gram Panchayat, being the 5th
2 respondent herein, is directed to consider and dispose of the representation dated 2nd February, 2026 within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps, in accordance with law. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
