ORDER:
The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate Writ Order or Direction more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondent Police in interfering with the personal liberty of the Petitioners and calling them to the police station in the absence of any FIR or registered criminal case as arbitrary illegal without jurisdiction and violative of the fundamental rights guaranteed under Articles 14 and 21 of the Constitution of India and consequently direct the Respondent Police not to interfere with or harass the Petitioners without following due process of law and pass …”
2. Heard the learned Counsel for the Petitioners and the learned Assistant Government Pleader. 3. Sri Sasi Kanth Busi, learned Counsel for the Petitioners submit that the Respondent Police, without any FIR or criminal proceedings, are arbitrarily summoning and harassing the Petitioners in relation to a purely civil dispute concerning Cash Credit Loans of Self‑Help Groups under “Kranthi‑2 SLF.” Petitioner No.1, engaged only as an Animator, had no custody or control over loan amounts, which were directly disbursed by Union Bank of India into the accounts of authorised group leaders, while Petitioner No.2 had no role whatsoever. The allegations of misappropriation are baseless and refuted by banking records. Such interference is wholly without jurisdiction, amounts to abuse of police power, and violates the Petitioners’ fundamental rights under Articles 14 and 21 of the Constitution of India, warranting issuance of a writ of mandamus restraining the Respondent Police from further harassment. 4.
Sri P.Ajay Babu, learned Assistant Government Pleader, on instructions, submits that the present Writ Petition is misconceived and devoid of merit. It is

contended that one Madduri Jayakrishna, S/o Anjaneyulu, lodged a complaint before the Station House Officer, Akividu Police Station on 23.01.2026, pursuant to which Crime No.37/2026 was registered under Sections 318(4), 316(5) read with 3(5) of ‘the BNS’, and the matter is presently under investigation. The Petitioners were called only for service of notice under Section 35(3) of ‘the BNSS’, and no harassment as alleged has occurred. The allegations in the Writ Petition are false, baseless, and invented solely to invoke the extraordinary jurisdiction of this Court. It is therefore urged that the Writ Petition be dismissed as against the Respondent Police, as the impugned action is lawful, within jurisdiction, and in the interest of justice. 5. This Court, upon careful consideration of the rival submissions, is of the view that while the Respondent Police are not precluded from discharging their statutory duties in relation to Crime No.37/2026. Accordingly, the Writ Petition is disposed of, directing the Respondent Police to scrupulously follow due process of law in all future proceedings, refrain from interfering in purely civil disputes, and ensure that no coercive steps are taken against the Petitioners except in accordance with law. There shall be no order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ Dr. Y. LAKSHMANA RAO, J Dated:09.02.2026 VTS
