Reports submitted by the State be kept with the record. Learned advocate for the petitioner submits that the petitioner is innocent of the charges and is behind the bar for two year six months; five witnesses have already been examined which do not lay any foundation of the case, as such, the petitioner may be released on bail on any stringent condition. Additionally, it has been submitted that the medicolegal examination do not support the prosecution’s case and unnecessarily the present petitioner is languishing in jail. 2 I have taken into account the deposition of the victim as well as the medicolegal examination report which reflect that at 2’ O clock vaginal opening; hymen torn and the opinion of the doctor depicts possibility of the victim being sexually assaulted. Mr. Gouranga Kumar Das, learned APP, appears for the State along with a junior of his choice as per the direction of this court. The appointment of both Mr. Das and the junior of his choice, if any, be regularized by the concerned authority. Learned advocate for the State has also drawn the attention of the court to the disability certificate which refers to mentally challenged person under the category of intellectual disability. The statement of the victim also reflects that she suffered from substantial deficiencies and is a challenged individual. Taking into account the overall circumstances of the case, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 2826 of 2025 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
