Accused Nos.3 and 4 in Crime No.55 of 2026 registered by Konanakunte Police Station, Bengaluru City, for offences punishable under Sections 316(1), 318(2), 61(2), 336(3) of BNS 2023 are before this Court in this petition filed under Section 482 of BNS 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.55 of 2026 was registered by Konanakunte Police Station, Bengaluru City, for the aforesaid offences against Anish K and others, based on the first information dated 20.02.2026, received from Sri Kumaresh, who is the authorized representative of financial company known as REPCO Home Finance Ltd.,. Apprehending arrest in the said case, petitioners herein who are arraigned as accused nos.3 and 4 in the FIR had filed Crl.Misc.No.2347 of 2026 - 3 - HC-KAR NC: 2026:KHC:34443 CRL.P No. 6243 of 2026 before the jurisdictional Sessions Court, which was rejected on 04.04.2026. Therefore, they are before this Court. 4. A reading of the first information would reveal that accused nos.1 and 2 had approached the complainant financing company for the purpose of availing loan of ₹.45,00,000/- and the petitioners herein had allegedly accompanied accused nos.1 and 2. Based on the documents submitted by accused Nos.1 to 4 before the financing company, the manager of the financing company, after obtaining legal opinion and valuation report from the legal advisor as well as empanelled property valuer of the company, had sanctioned loan to accused nos.1 and 2. 5. Accused nos.1 and 2 have been granted anticipatory bail by this Court in Criminal Petition No.6358 of 2026 and Manager of the company who is arrayed as accused no.9 has been granted anticipatory bail by this Court in Criminal Petition No.6208 of 2026. Under the circumstances, I am of the opinion that the petitioners have made our a case for grant of anticipatory bail. - 4 - HC-KAR NC: 2026:KHC:34443 CRL.P No. 6243 of 2026 6. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.55 of 2026 registered by Konanakunte Police Station, Bengaluru City, for offences punishable under Sections 316(1), 318(2), 61(2), 336(3) of BNS 2023 subject to the following conditions: 1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioners shall not tamper with the prosecution witness and they shall co-operate - 5 - HC-KAR NC: 2026:KHC:34443 CRL.P No. 6243 of 2026 with the Police for investigation and appear before them whenever called upon. 4.
