In the matter of : Salam Sk @ Abdul Salam Sk
… Petitioner(s)
Mr. Sagar Saha
… for the Petitioner(s) Mr. Rajendra Banerjee,ld. APP Mr. Sandeep Prasad Shaw
… for the State-respondent(s)
Learned advocate for the petitioner submits that the petitioner is in custody for two years five months and, although, charge-sheet has been submitted but, till date, the case has not been committed to the Court of Sessions. It is also submitted that the principal accused is still absconding and there is no possibility of the trial being concluded in the near future, as such, learned advocate for the petitioner prays that the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the eyewitnesses under Section 164 of the Cr.P.C.
2 I have taken into account the gravity of the offence as also the complicity of the present petitioner who has been implicated for handing over the sharp cutting weapon to the principal accused. Having considered the period of detention, without entering into the merits of the case, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Salam Sk @ Abdul Salam Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned court and shall not leave the district of Malda without prior permission of the Court. Additionally, if on bail, till charges are framed by the learned Sessions Court, the petitioner would meet with the Inspector-in-charge of the concerned police station or any officer assigned by him/her once in a fortnight. Accordingly, CRM (M) 2827 of 2025 is allowed.
