The Writ Petition has been filed for the following relief:
“…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the actions of the respondents in interfering with the peaceful possession and enjoyment of the Petitioners with regard to their respective Properties of an extent of Ac.01.70 Cents situated at Survey No.1767-2, an extent of Ac.01.70 Cents situated at Survey No. 1767-3 and an extent of Ac.01.73 Cents situated at Survey No. 1767-4 of Poli Village, Rajampeta Mandal, YSR Kadapa District, Andhra Pradesh, without following due process of law as illegal, arbitrary, violation of principles of natural justice and in violation of Articles 14, 21 and 300-A of the Constitution of India and Consequently direct the Respondents not to interfere with the peaceful possession and enjoyment of the Petitioners with regard to their respective Properties, in any manner, in the interest of justice and to pass …”
2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader for Revenue Department. 3. Mr. D. Anilkumar, learned counsel for the Petitioners, submits that Respondents are attempting to dispossess the Petitioners from the land bearing Sy.Nos.1767-2, 1767-3 and 1767-4, admeasuring Ac.1.70 cents, Ac.1.70 cents and Ac.1.73 cents respectively of Poli Village, Rajampeta Mandal, YSR Kadapa District, without following due process of law. 4. Mr. B. Venkata Satyanarayana, learned Assistant Government Pleader for Revenue, on written instructions, submits that the land in Sy. No.1564, an extent of 320.64 acres is classified as Waste (Gayalu) as per R.S.R. and land in Sy. No.1767 an extent of 6.83 acres has been carved out of old Sy.No.1564 as per the proceedings of Assistant Director of District Survey and Land Records, Kadapa, vide Ref.No.E/144/07, dated 12.03.2007. counsel for the Petitioners contend that they have got appropriate revenue documents to hold the property. 5. Be that as it may, Respondents shall not dispossess the Petitioners from the land, without following due process of law. 6.
Having regard to the facts and circumstances of the case, and upon recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondents not to dispossess the Petitioners from the agricultural land without following due process of law.
